فإن الفقه عماد الحق ، ونظام الخلق ، ووسيلة السعادة الأبدية ، ولباب الرسالة المحمدية ، من تحلى بلباسه فقد ساد ، ومن بالغ في ضبط معالمه فقد شاد ، ومن أجله تحقيقا ، وأقربه إلى الحق طريقا : مذهب إمام دار الهجرة النبوية ، واختيارات آرائه المرضية لأمور : منها : ورود الحديث النبوي فيه ، وتظاهر الآثار بشرف معاليه ، واختصاصه بمهبط الرسالة ، وامتيازه بضبط أقضية الصحابة حتى يقول إمام الحرمين - رحمه الله - : وأما مالك - رحمه الله - في أقضية الصحابة رضي الله عنهم ، فلا يشق غباره ، ويقول الشافعي - رحمه الله - : إذا ذكر الحديث ، فمالك النجم ، ويقول أيضا لأبي يوسف : أنشدك الله أصاحبنا - يعني مالكا - أعلم بكتاب الله أم صاحبكم يعني أبا حنيفة ، فقال صاحبكم ، فقال أصاحبنا أعلم بسنة رسول الله أم صاحبكم ، فقال صاحبكم ، فقال أصاحبنا أعلم بأقضية الصحابة رضوان الله عليهم أم صاحبكم ، فقال صاحبكم ، فقال : فإذن لم يبق لصاحبكم إلا القياس ، وهو فرع النصوص ، ومن كان أعلم بالأصل كان أعلم بالفرع .
