والبحث الفقهى له مصطلحاته وتفريعاته بشكل كثيراً ما لا يتيسر للسائلين والمطالعين وهنا تكون للفتوى حاجة ملحة من حيث أنها أقرب للمراد قولاً وأسرع في الفصل عملاً ومما يزيد الفتوى سرياناً واتباعاً.1- أن تكون أكثر جرياناً ودوراناً.2- أن تعتمد على الدليل الواضح بعيداً عن النظر القصير والنزاع العقيم.3- أن يراعى في الصياغة والعرض التقريب عند الاختلاف.وقد يقتضى الحال اختصاراً دقيقاً في الإجابة علي مثال قولـه تعالى:{وَيَسْأَلُونَكَ عَنِ الرُّوحِ قُلِ الرُّوحُ مِنْ أَمْرِ رَبِّي}.وقد تطول - قليلاً كإجابة السائل عن أهل الكهف وما كان من أمرهم فقد استوعبت عشر آيات من 13-22 والإجابة عن ذي القرنين بلغت ست عشرة آية من 83-98.وقد تطول الإجابة كثيراً على امتداد سورة كاملة هي سورة يوسف.وتعدد وجهات الإجابة - إذا صدرت عن ثقة - ظاهرة طبيعية مادامت لا تستهدف الخلاف الرامي إلى الاختلاف وأن تأخذ في الاعتبار النص وروح النص في إطار ثابت وسوى وإنما تأتى آفة البحث من الجمود والجحود.
