الحمد لله رب العالمين والصلاة والسلام على خاتم الأنبياء والمرسلين . أما بعد :
فإنه سبق أن أصدرت رسالة سميتها بـ « النصائح المنجية من الفضائح المخزية » في الاتفاقية التي جرت بين (الجبهة المتحدة الإسلامية في الصومال الغربي ) وبين (الحكومة الإثيوبية ) خلصت فيه إلى بطلان الاتفاقية بين الطرفين وتكفير الجبهة كطائفة والمفتي والمسرّ بها بعد العلم بحقيقة ما جرى والدعوة إلى التوبة ومراجعة الصواب فأعقبه تصريحات متنوعة من بعض طلبة العلم قرروا فيها :
١ . شرعيّة المعاهدة التي جرت بين الجبهة وبين الحكومة الإثيوبية لأنها تحقق في نظرهم ما لم يحققه الجهاد ، وأنها اشتملت على ما يناقض أصل الدين نظراً لما في الفقرة الخامسة من البند الأول للاتفاقية بين الطرفين .
۲ . عدم تكفير الجبهة لشبهة الإكراه ، رغم التقرير بالبطلان وعدم الإكراه .
۳ . أن تكفير الجبهة مع الإكراه المدّعي من الغلو في الدين أو المغالاة .
4 . تكفير المفتي وكذا المسرّ بالاتفاقية من المغالاة في الدين أيضا رداً على ما جاء في (النصائح ) مع بتر ظاهر صارخ من المدافع . . .
5. طرح مسألة التجنس بجنسية دولة كافرة في سياق الدفاع عن الجبهة .
6 . توجيه توصيات إلى الجبهة مفادها : الاستمرار في المعاهدة والإفادة منها لصالح الإسلام والمسلمين على زعمهم ! فاقتضى المقام التنبيه على بعض الملحوظات التي بدت من بيانات المدافعين والتي قد يغتر بها بعض المتحمسين للجبهة بدوافع مختلفة على شكل مسائل :
