تهدف السياسة الجنائية إلى زجر الجاني وردع غيره من خلال وسائل وتدابير تشريعية لمكافحة السلوك المنحرف حفاظا على الأمن والاستقرار السياسي والاجتماعي ، والانتخابات بوصفها أداة لتخويل السلطة من قبل مالكها عن طريق ممثليه في المجالس النيابية أو الرئاسية بحسب النظام الدستوري الحاكم في الدولة ، ومن هنا فلابد للسياسة العقابية أن تكون فاعلة كيما تؤدي الغرض المرجو منها ، ومن هنا جاءت الدراسة محاولة لدراسة فاعلية السياسة العقابية في التشريع العراقي ، والمقارن في جزئية محددة ومهمة من العملية الانتخابية الا وهي جزئية التصويت .
