علي عبد الرازق، اسمه بالكامل علي حسن أحمد عبد الرازق (1888 - 1966) هو مؤلف كتاب الإسلام وأصول الحكم. ولد في قرية أبو جرج بمحافظة المنيا في أسرة ثرية تملك 7 آلاف فدان. حفظ القرآن في كتاب القرية، ثم ذهب إلى الأزهر حيث حصل على درجة العالمية. ثم ذهب إلى جامعة أوكسفورد البريطانية. وعقب عودته عُين قاضيا شرعيا.

أصدر عام 1925 كتاب الإسلام وأصول الحكم الذي يدعو إلى فصل الدين عن السياسة والذي أثار ضجة بسبب آرائه في موقف الإسلام من "الخلافة"؛ فرد عليه الأزهر بكتاب "نقد كتاب الإسلام وأصول الحكم" ثم سحب منه شهادة العالمية، وشن حملة على رأيه. عمل علي عبد الرازق بالمحاماة، ثم انتخب عضوا في مجلس النواب، ثم عضوا في مجلس الشيوخ، ثم اختير وزيرا للأوقاف.

ولي المؤلف رحمه الله القضاء بمحاكم مصر الشرعية ، كان ذلك حافزا له للبحث عن تاريخ القضاء الشرعي .
والقضاء بجميع أنواعه فرع من فروع الحكومة ، وتاريخه يتصل بتاريخا اتصالا كبيرا ، وكذلك القضاء الشرعي ركن من أركان الحكومة الإسلامية ، وشعبة من شعبها ، ولابد حينئذ لمن يدرس تاريخ ذلك القضاء أن يبدأ بدراسة كنه الأول ، أي الحكومة في الإسلام .
وأساس كل حكم في الإسلام هو الخلافة والإمامة العظمة – على ما يقولون – فكان لا بد من بحثها .
فشرع المؤلف في بحث ذلك كله ، وهذه كما قال ثمرة عمل بذل له أقصى ما مالك من جهد ، وأنفق فيه سنين كثيرة العدد . كانت سنين متواصلة الشدائد ، متعاقبة الشواغل ، مشوبة بأنواع الهم ، مترعة كأسها بالألم .
وهو أقصى ما وصل إليه بحثه وغاية ما وسعته نفسه.
