إنّ لكل من الشرائع الوضعيّة والشريعة السماوية أحكام، ما هي إلا نهي وأمر وقد يلتقي كلا الشرعين أحياناً في المنهي عنه، ومن ذلك أن بعض الموبقات في الشريعة الإسلامية تعتبر جرائم لا تغتفر في الشرائع الوضعية فقتل النفس التي حرم الله إلا بالحق لا تجيزه القوانين أيّن كانت، والتولي يوم الزحف يعتبر في السنن البشرية خيانة ومع هذا فإن التلاقي في بعض المنهي عنه لا يعني التطابق بين كلا الشرعين فشتان ما بينهما ومنه أن العقاب ليس بواحد فبينما تتخذ الدول المتحضرة في قوانينها من حجز الحرية كأقصى حد لبعض الجرائم فإن الشريعة الإسلامية قد يصل العقاب فيها على بعض المعاصي إلى حد الردع، ومن ذلك أن قتل النفس التي حرم الله يقع عليه القصاص بأن يقتل الجاني (مرتكب الجريمة) في حين تتخذ البعض من القوانين البشرية من حجز الحرية بالسجن كعقاب لهذه الجريمة، والسارق في القوانين البشرية يسجن في حين أنّ الحد على هذه المعصية في الشرع الإسلامي هو قطع اليد ولا يقتصر العقاب في الشريعة الإسلامية على بعض الجرائم بشكل دنيوي، بل لبعض المعاصي آثار تلاحق مقترفيها في عالم البرزخ وفي يوم القيامة.
