لما كان عقد البيع من عقود التراضى التى تتم وتنتج آثارها بين طرفيها بمجرد اتفاق الطرفين على العقد سجل العقد أو لم يسجل إذ التراخى فى التسجيل لا يغير من طبيعته ولا من تنجيزه ، وأنه ولئن كان قانون تنظيم الشهر العقارى رقم 114 لسنة 1946 قد تطلب شهر عقد البيع متى كان محله عقارا أو حقا عينيا على عقار كيما تنتقل ملكية العقار المبيع أو الحق العينى إلا أن التراخى فى التسجيل لا يخرجه عن طبيعته بوصفه من عقود التصرف ولا يغير من تنجيزه
