إن من الخصائص التي خص الله بها الشريعة الإسلامية ,أن جعلها سمحاء , حنيفية , تقوم على السهولة , والرفق , وتدعو إلى التيسير والتخفيف , و رفع الحرج , والمشقة عن المكلفين , ومن ثم فاضت بأحكام الرحمة للعالمين جميعًا فقال سبحانه وتعالى بطريق الحصر, مبيّنًا الهدف من بعثة رسول الإسلام r : ] وَمَا أَرْسَلْنَاكَ إِلَّا رَحْمَةً لِلْعَالَمِين [؛ لأن هدفها تحقيق مصالح المكلفين في العاجل والآجل معًا , على أساس من العدل , والرحمة بالخلق أجمعين , فليس العدل وحده هو أساس قيام المصالح , وإنما بالرحمة التي تفيض بالعدل , والرفق , والسماحة , والتيسير على المكلفين , وهذه ميزات للشريعة الإسلامية عامة , والفقه الإسلامي خاصة
