--الإلمام بأحكام توريث ذوو الأرحام أو: ميراث ذوي الأرحام أو: إرث ذوي الأرحام أو: توريث ذوي الأرحام أحد أبواب المواريث في الفقه الإسلامي، وغالبا ما يكون ملحقا في آخر أبواب فقه المواريث. وذوو الأرحام في اللغة: أقرباء الميت أو: كل ذي قرابة مطلقا، وفي الاصطلاح هم: "كل قريب للميت، ليس ذا سهم ولا عصبة" أو: "كل ذي قرابة ليس بذي فرض ولا عصبة"، أي: أنهم كل قريب غير وارث، لا بالفرض ولا بالتعصيب، وهم: من ينتمي إلى فروع الميت أو أصوله، مثل: أولا البنات، والأجداد والجدات غير الوارثين، والأخوال والخالات والعمات، ومن أدلى بهؤلاء، وإنما يرثون عند عدم وجود وارث بالفرض ولا بالتعصيب. وممن قال بعدم توريثهم: زيد ابن ثابت، ومالك والشافعي، وقال بتوريثهم عدد من الصحابة، والتابعين، والحنفية، وأصحاب مذهب التنزيل، وأصحاب مذهب أهل القرابة، كما أن من فقهاء الشافعية من قال بتوريثهم. واتفقت الأقوال على عدم توريثهم عند وجود وارث بالفرض أو بالتعصيب، ووقوع الخلاف إنما هو بسبب من هو أولى منهم في الاستحقاق. وللقول بتوريث ذوي الأرحام ثلاث طرق: طريقة مذهب أهل القرابة يعدونهم كالعصبات، وطريقة أهل التنزيل، يجعلون كل ذي رحم في منزلة من أدلى به من الوارثين، وطريقة مذهب أهل الرحم، يورثونهم بالتسوية.
