ودراسته لهذا الموضوع اقتضت منه بداية أن يدرس كيف نشأ الحق في الحياة الخاصة، ثم يحدد مدلول الحياة الخاصة ومن ثم يتناول مسألة الحق في الحياة الخاصة في القانون الجنائي بصفة عامة، فيعالج الشق الخاص بالتجريم، ثم الشق الخاص بالضمانات الإجرائية، لتكتمل للقارئ صورة الحق في الحياة الخاصة في القانون الجنائي، ولرسم معالم الصورة بطريقة واضحة حاول قدر استطاعته أن يغذي بحثه بما عليه العمل في القانون والفقه والقضاء المقارن على ذلك يساعد التشريعات العربية على الاحتواء والاقتباس من هذه القوانين مع إدخال التعديلات والضمانات التي تتفق وطبيعة الشعوب، كما وعرض لمسالة الحياة الخاصة في القانون المدني وذلك ليشدد الارتباط بين الأمرين، ورد على سؤال أساسى يدور في ذهن القارئ وهو: هل مدلول الحياة الخاصة أمام القاضي المدني يختلف عن مدلولها أمام القاضي الجنائي؟
