مما لا شك فيه أن حق الهيئة الإجتماعية في عقاب الجاني ينشأ بمجرد وقوع الجريمة، والوسيلة التي تصل بها الدولة إلى إقتضاء حقها في العقاب هي الدعوى الجنائية، عن طريق ما رسمه القانون من إجراءات للوصول إلى هذا الحق.
إذ تبدأ هذه الدعوى سيرها الطبيعي عقب إرتكاب الجريمة في أغلب الأحيان، إلا أنه من المتصور إلا تبدأ مباشرة الدعوى وفق الأصول المقررة لها إلا بعد زمن طويل، فإذا لم تحرك ظلت راكدة وضاع حق المجتمع في العقاب، وأفلت الجاني منه وانقضت تبعاً لذلك الدعوى الجزائية.
والمقصود بإنقضاء الدعوى الجزائية، إنتهاؤها، وإذا كان الوضع الطبيعي لإنقضاء الدعوى الجزائية بصدور حكم أو قرار نهائي فيها بالإدانة أو البراءة هو الأفضل والحب للنفوس لأنها بذلك تكون قد استنفذت غرضها وأدت وظيفتها، إلا أنها قد تنقضي كذلك لأسباب أخرى كالوفاة والعفو العام والتقادم، مما دعا البعض إلى إعتبار هذه الأسباب التي تنقضي بها الدعوى الجزائية، أسباباً عارضه سموها أسباب سقوط تمييزاً لها عن إنقضاء الدعوى الجزائية بالطريق الطبيعي لها ألا وهو الحكم الصادر فيها، على أساس أنه بهذه الأسباب العارضة تنقضي الدعوى عادة قبل أن يقضى فيها فيكون هذا الإنقضاء مبتسراً أي سابقاً لأوانه الطبيعي، إلا أن العمل قد جرى في الواقع على عدم التفرقة ما بين السقوط والإنقضاء وأنه يجوز إستعمال أياً من الوصفين محل الآخر.
