مما لا شك فيه أن هناك مجموعة من الأسباب تقل عزيمة المستثمرين العرب لناحية استثمار أموالهم في الأقطار العربية الأخرى، وأهم هذه الأسباب على الخصوص: التخوف من المخاطر غير التجارية، التي يمكن أن تتعرض لها استثماراتهم، مثل التأميم، وفرض الحراسة، إلى جانب الإجراءات السياسية الأخرى كالحرب والثورات الداخلية ضد السلطة العامة في الدولة المضيفة لها.
وقد أدركت الأقطار العربية المستضيفة لرؤوس الأموال العربية خطورة الوضع، فحاولت بوسائل مختلفة أن تصلح من مناخها الاستثماري على نحو يدفع المستثمر العربي إلى الاطمئنان على استثماره، بتنظيم معاملته وحمايته عبر مجموعة من القواعد تراها كفيلة بتحقيق أهدافها في جذب المال العربي إليها.
وتهتم هذه الدراسة للنظام القانوني المنظم لانتقال رؤوس الأموال بين الأقطار العربية بمدى تأثر الأدوات القانونية المنتظمة لهذا الانتقال بمستجدات الساحة السياسية العربية. كما تهتم بمدى تأثر انتقال رأس المال بين الأقطار العربية بسياسة المحاور العربية.
من ناحية أخرى، إن البحث في الأدوات القانونية المنظمة لانتقال رأس المال بين الأقطار العربية يعتبر جزءاً من القانون الدولي الاقتصادي، ويرمي إلى إرساء أسس نظام قانوني عربي اقتصادي على المستوى الإقليمي، يخدم النظام الاقتصادي العربي القائم في تطوره وثباته، ثمة ضرورة لمحاولة استنطاق مكوناته منذ سنة 1945 إثر نشأة ما اصطلح على تسميته "النظام الإقليمي العربي".
