تدور الدراسة في هذا الكتاب حول الخطاب الشرعي وطرق استثماره، وقد جاءت ضمن أبواب ثلاثة تناولت المواضيع التالية: أولاً مفهوم الخطاب وعناصره، ثانياً: أسباب استثمار الخطاب، ثالثاً: طرق استثمار الخطاب ومراتبها، جاء الباب الأول مشتملاً على مفهوم الخطاب، وأقسامه، وأنواعه، ومضمونه، وموضوعه، حتى إذا ما تبين للباحث مفهوم الخطاب بجميع أبعاده، عمد إلى تحليله إلى عناصره اللغوية من جميع المستويات الدلالية، من مستوى ما وضعت له الألفاظ، ومن مستوى ما تستعمل فيه الألفاظ، ومن مستوى ما تحمل عليه الألفاظ، متجها بعد ذلك إلى العناصر السياقية والمقامية، فحدد مفهوم السياق إجمالًا ثم تفصيلاً بذكر أركان التخاطب منتقلا بعد ذلك إلى الأسباب الداعية إلى استثمار الخطاب، متحدثا عن الأسباب التي ترجع إلى المخاطب ولغة الخطاب، وبتصرفات المخاطبين ليقف بعد ذلك على أهم سبب حرك عقل الأصوليين، وهو أن النصوص متناهية والأحداث غير متناهية، وما يتناهى لا يستوعب مالا يتناهي، لينتقل من ثم لتلمس الإجابة عن هذا الإشكال في الباب الثالث من أبواب هذه الدراسة وهو طرق استثمار الخطاب ومراتبها.
وبعد وقوفه على جانب من الإجابة، في امتدادات الخطاب، أعطى الباحث طرق استثمار الخطاب ثلاثة أبعاد كبرى بحكم أن اللفظ إما أن يدل على الحكم بصيغته ونظومه، أو بفحواه ومفهومه، أو بمعناه ومعقوله، وهو الاقتباس الذي يسمى قياساً ولما كان المعقول يتنوع إلى نوعين: جزئي وكلي عقد الباحث له فصولاً ومباحث تناول كل تعلقاته بالدرس والتحليل. وقد راعى الباحث في دراسته جانب التدرج سواء على مستوى الخطاب ذاته أو على مستوى دلالته على الأحكام، كذلك حرص على تبيان وجهة نظر كل من المدرستين: مدرسة المتكلمين، ومدرسة الفقهاء، في كل مسألة هي في حاجة إلى بيان المدرستين معاً.
