لقد تطور القانون الدولي العام تطوراً واضحاً منذ العصور القديمة، حيث ظهرت فيه فروعاً جديدة، خصوصاً بعد الحرب العالمية الثانية، ومن أهمها القانون الدولي لحقوق الإنسان، وأكثر ما يميز هذا النوع هو الإهتمام بالإنسان إلى جوار الدولة، وربما كان القانون الدولي لحقوق الإنسان من أكثر الفروع تطوراً وتحديثاً.
إن هذا الفرع من الفروع الحديثة يتميز بإدخال مفاهيم جديدة كالتنمية والصحة والتعليم وأخرى متعلقة بالبيئة والتلوث، وغيرها من المفاهيم التي لم تكن ملحوظة في القانون الدولي العام التقليدي، وربما كان لهذا التطور السريع الدور الأساسي في ظهور مفهوم التنمية كحق من حقوق الإنسان الأساسية، الأمر الذي جعل الحكومات في الوقت المعاصر تدرك أهميتها وضرورة إستدامتها.
إن الحق في التنمية هو حق مرتبط بحق تقرير المصير حيث تجنيد الموارد بهدف رفع مستوى الحياة، مع إعتبار المشاركة في التنمية والإفادة منها حق للأفراد لكونهم محور عملية التنمية غير القابلة للتصرف ذو البعد الإقتصادي والإجتماعي والثقافي والسياسي إبتغاء توفير الحد الأدنى للمعيشة.
