يضم هذا الكتاب بعض المباحث الفقهية التي جرت عادة الفقهاء على ذكرها في مقدمة كتاب التجارة تسمى بالمكاسب المحرمة أو التي قيل بحرمتها، وتشمل بعض المكروهات والمباحات حسبما يؤدي الدليل. أخذاً بعين الاعتبار أن الشريعة تنظر إلى الإنسان بجميع شؤونه الخاصة والعامة الروحية والبدنية والمعنوية ليعطي لكل الحالات الحكم المناسب الذي يعلم الله بأنه من صالح هذا الإنسان. ولذلك لا تخلو واقعه في الشريعة الإسلامية أو أية حالة مفترضة من حالات الإنسان من أحد الأحكام الإلزامية أو الترخيصية من الوجوب والحرمة والكراهة والإباحة والإستحباب.
وقد قسم الفقهاء البحث في المكاسب المحرمة إلى خمسة أنواع، نوع يحرم التكسب به لكونه محرماً بنفسه، ونوع يحرم التكسب به بتحريم ما يقصد به سواء كان في نفسه محرماً أو غير محرم ونوع يحرم التكسب به لقلته وخسته، ونوع هو الأعيان المحكومة بالنجاسة في الشريعة الإسلامية من حيث الحكم التعليقي المتعلق بها، وبأنحاء استعمالها ومن حيث التعامل بها صحته وفساداً، لنوع الأخير هو الأعمال الواجبة أو المستحبة أي المشروعة في حق الإنسان بالنسبة إلى تكليف نفسه، وأنه هل يصح التعامل عليها بأن يؤديها بعوض مع كونها واجبة عليه أو لا.
