حين وضع مناهج هذا الكتاب استوقف الكاتب النظر حول المشاركة القائمة بين بحوث المصالح المرسلة في مفهوم الإسلام وبين التكافل الاجتماعي وقواعده في مفهوم الشرع الحنيف وأن هناك تشابه بين الموضوعين فالاستصلاح الذي هو المصلحة المرسلة نوع من أنواع الرأي المستند إلى المصلحة وذلك في كل مسألة لم يرد في الشريعة نص عليها, ولم يكن في الشريعة أمثال تقاس عليها وإنما بني الحكم فيها غلى ما في الشريعة من قواعد عامة برهنت على وقوعها على الحقيقة ودخولها ضمن التشريع, أما التكافل الاجتماعي فمضمونه جملة قواعد اعتمدت على أصول وفروع وقواعد عامة استمدت حقائقها من الكتاب والسنة ومصادر التشريع كالاستصلاح واعتمدت على نظريات وآراء للناس برهنت على حيويتها ومرونتها وقابليتها للتحقيق وإذن فالهدف يكون متشابهاً بين مواضيع الاستصلاح والتكافل فكان لابد من عرضها ضمن حلقتين تلتصق إحداهما بالأخرى وتتغذيان من نسغ واحد وتسقيان من ماء واحد. ويتناول الكتاب بالبحث ما يلي: مصادر التشريع الإسلامي, المصالح المرسلة, المصالح المرسلة والمنفعة, المصلحة المرسلة ومقابلتها بالنصوص, التكافل الاجتماعي الإسلامي.
من مواليد حمص 1926. تخرج من كلية الحقوف جامعة دمشق عام 1949. حصل على اختصاص في الحقوق الخاصة عام 1950. حصل على لقب استاذ في المحاماة 1953 و انتسب إلى نقابة المحامين السورية. درس دبلوم الشريعة الإسلامية في جامعة القاهرة. حصل على ماجستير في الدراسات الإسلامية من جامعة كراتشي في الباكستان عام 1989 . نال الدكتوراه في الفلسفة الإسلامية بدرجة امتياز من جامعة الدراسات الإسلامية في كراتشي باكستان 1991. له العديد من المؤلفات في علوم الاجتماع و الخدمات الاجتماعية و البر في الإسلام و الشريعة الإسلامية.
