وهذا التشريع في عقيدة بعض الناس، أنه لا يتفق مع العصر الحاضر، ولا يصلح للتطبيق اليوم، وهي عقيدة فاسدة ضالة، وإذا حاول منصف أن يتعرف على هذا التشريع الرائد، لاقتنع وعرف الحقيقة ناصعة جلية في قدرة هذا التشريع الجنائي، وكل التشريعات الإسلامية، على مواكبة العصر، وصلاحها للتطبيق. ومن دواعي هذا، إبراز المنهج التطبيقي للتشريع الجنائي الإسلامي، وما غمط من حق هذا المنهج.
