الحق العيني هو سلطة مباشرة لشخص على شيء مادي، فهو يخول صاحبه مكنةً مباشرة دون حاجة إلى وساطة شخص آخر. فصاحب الحق العيني يمكنه الاستئثار مباشرة بالقيمة الاقتصادية للشيء الذي يرد عليه حقه، ودون حاجة إلى مطالبة شخص آخر بتمكينه من ذلك، لأن حقه ينصبّ مباشرة على الشيء. وهو في ذلك يختلف عن الحق الشخصي الذي لا يمكن لصاحبه مباشرته إلا بواسطة المدين. فالحق العيني يتحلل إذن إلى عنصرين فقط هما صاحب الحق، والشيء الذي يرد عليه الحق. هذا وتنقسم الحقوق العينية إلى نوعين: حقوق عينية أصلية، وحقوق عينية تبعية. فالحقوق العينية الأصلية هي الحقوق التي تقوم بذاتها مستقلة فلا تستند في وجودها إلى حق آخر تتبعه. ويعتبر حق الملكية من أهم الحقوق العينية الأصلية، فهو أوسع الحقوق العينية نطاقاً، حيث يخول صاحبه كافة السلطات المتصورة على الشيء، حيث يكون له استعماله واستقلاله والتصرف فيه. والحقوق العينية الأصلية الأخرى هي، في الواقع، حقوق متفرعة عن حق الملكية، وهي تخول صاحبها سلطات محددة على شيء مملوك للغير. وتشمل الحقوق العينية الأصلية المتفرعة عن حق الملكية في القانون المصري حق الانتفاع، وحق الاستعمال، وحق السكنى، وحقوق الارتفاق.. وتشمل هذه الحقوق في القانون اللبناني حق التصرف، وحق السطحية، وحق الانتفاع، وحقوق الارتفاق، وحق الخيار الناتج عن الوعد بالبيع، وحق المساقاة.
أما الحقوق العينية التبعية، فهي حقوق لا توجد مستقلة بذاتها وإنما تستند في وجودها إلى حق شخصي لضمان الوفاء به، فهي تكون تابعة لهذا الحق، وتسمى هذه الحقوق بالتأمينات العينية. وتشمل الحقوق العينية التبعية في القانون المصري الرهن الرسمي، وحق الاختصاص، والرهن الحيازي، وحقوق الامتياز. وتشمل هذه الحقوق في القانون اللبناني الرهن، والبيع بالوفاء، والتأمين وحقوق الامتياز.
ويقدم هذا الكتاب موجزاً عن الحقوق العينية الأصلية وذلك من خلال دراسة تناولت في جزئها الأول حق الملكية، وانقسمت الدراسة لهذا الحق إلى بابين على النحو التالي: الباب الأول: حق الملكية في ذاته، الباب الثاني: أسباب كسب الملكية.
