قليلة هي الدراسات والبحوث التي تتناول المسؤولية القانونية في بيع الأدوية والأعشاب الطبية اليوم. هذا الواقع جعل من الأستاذ صفاء شكور عباس وضع دراسة عن (تعدد المسؤولين عن الدواء المعيب) العنوان الذي اختاره للحديث عن هذه المنجاب أو السلع في الفقه المدني العراقي، وبالأخص ما يسنى بالمسؤولية التضامنية، على الرغم من أهميته ووجود عدد تطبيقات تشريعية له في القانون المدني.
وفي هذا السياق بادر المؤلف إلى تحليل الآراء الفقهية والنصوص القانونية واستخلاص النتائج العلمية واستعراض الأحكام ذات الصلة بالموضوع وتحليلها بالإرتكاز على المنهج التحليلي المقارن في العراق ومصر والأردن مع الإشارة إلى بعض القوانين الأخرى تلك التي تدور في إطار القواعد العامة الواردة في التشريعات المدنية، أم في نطاق التشريعات الخاصة بمزاولة مهنة الصيدلة، وقوانين الصحة العامة، والقوانين الخاصة بحماية المستهلك.
قسم الكتاب إلى ثلاثة فصول: خصص الفصل الأول للتعريف بالدواء المعيب وحالاته، وتناول الفصل الثاني نطاق المسؤولية عن الدواء المعيب وتكييفها القانوني: مسؤولية الطبيب والصيدلي عن الدواء المعيب وتكييفها القانوني. وكذلك مسؤولية: المنتج والموزع والدولة... أما الفصل الثالث والأخير فتناول الآثار المترتبة على تعدد المسؤولين عن الدواء المعيب... وختم الكتاب بـ استنتاجات وتوصيات.
