إن معرفة مقاصد الشريعة تساعد في فهم النصوص الشرعية، وتفسيرها بشكل صحيح عند تطبيقها على الوقائع مما يضفي على الفقه حياة تمكنه من الدخول على القلوب بغير استئذان، ومن لم يتغطن لوقوع المقاصد في الأوامر والنواهي فليس على بصيرة من وضع الشريعة، كما تساعد هذه المعرفة على معرفة القياس الصحيح من الفاسد فلا يعرف ذلك إلا من كان خبيراً بأسرار الشرع ومقاصده.
هذا وإن كان الكتابة في موضوع المقاصد لا تزال قليلة جداً، وتحتاج إلى مزيد من عناية الباحثين. وقد حظي الشاطبي بمن بحث مقاصد عنده، أما عز الدين بن عبد السلام، فليس هناك من تناول دراسة المقاصد عنده، مما يؤكد أهمية البحث الذي ضمه هذا الكتاب والذي جاء كرسالة جامعية لنيل درجة الدكتوراه في أصول الفقه. ويعد البحث إسهاماً من الباحث في أحياء التراث الفقهي والأصولي الذي تركه لنا إمام العز، وكشفاُ عن منهجه في طرح المقاصد، وتقويماً لهذه الجهود.
أما المنهجية التي اتبعها الباحث فقد كانت على الشكل التالي: 1-جمع المادة من مراجعها الأصلية وعرضها عرضاً مناسباُ في كل فقرة من فقرات البحث، بالاعتماد على مؤلفات الإمام الخاصة، وعلة ما كتب حول مقاصد الشريعة وأهداف التشريع عامة. 2-عرض ملخص موجز لترجمة الإمام العز يوضح معالم حياته ويرسم صورةً أقرب ما تكون إلى واقعه. 3-الكشف عن نظرته في المقاصد وترتيب ذلك ضمن أبواب وفصول ومباحث. 4- إتباع المنهج التحليلي والاستنباطى لعرض المقاصد عند الإمام العز، وذلك من خلال عرض آرائه وتحليها، ثم استخلاص المبادئ العامة منها، مع المقارنة بآراء غيره إن اختص الأمر. 5-تم بث التطبيقات الفقهية في أثناء البحث حتى تكوم مرتبطة بالقاعدة الأصولية المتفرعة منها. 6- ترقيم الآيات وتخريج والأحاديث والآثار والحكم عليها بما حكم به علماء الحديث. 7-ترجمة معظم الأعلام الواردة في البحث ترجمة مختصرة تركت به بعض تعليقات عند اللزوم.
