تعتبر الملكية العقارية عماد الملكية الخاصة، وقد حرص الدستور اللبناني على تبيان أهميتها، وأحاطتها بحماية دستورية، حيث نصت المادة 15 منه على أن الملكية في حمى القانون - فلا يجوز أن ينزع عن أمد ملكه إلا لأسباب المنفعة العامة وفي الأحوال المنصوص عليها في القانون، وبعد تعويضه منه تعويضاً عادلاً.
هذا ويتشدد القضاء في منع أي إعتداء أو تجاوز يطال الملكية الفردية العقارية التي هي في حمى الدستور والقانون، ويعد موضوع إزالة التعدي على الملكية العقارية من المواضيع الهامة جداً والحساسة التي تعرض على القضاء سواء قضاء الأساس أو قضاء الأمور المستعجلة، أو حتى القضاء الجزائي، هذا الموضوع يشكل الجزء الأول من سلسلة القضاء العقاري.
أما الجزء الثاني فتناول موضوع "حق الإرتفاق بالمرور"، وتناول سلسلة القضاء العقاري مجموعة من القضايا العقارية الهامة، التي تساهم في تسهيل مهمة رجل القانون وكل باحث في علم القانون.
