هذا الكتاب يتناول وجهاً من وجود أزمة الإجتهاد الفقهي المعاصر، فينظر للقضية من الناحية التربوية، ويخلص إلى أنه لا سبيل لنهضة فقهية إلا بإصلاح المنظومة التعليمية للعلوم الشرعية، وخصوصاً إصلاح تدريس الفقه.
انتهجت الدراسة طريقاً ثُنائي المَسْلك، إذ انطلقت من دراسة تاريخية تحاول استنطاق التراث التربوي، من أجل إستفهام روحه المبدعة، فأسفر ذلك عن ملاحظة أربعة مناهج في تدريس الفقه اعتمدها رواد المدارس التربوية بالغرب الإسلامي، ثم عملت على تشخيص مكامن الخلل في المناهج المتداولة اليوم، لتنتهي إلى دَمْج المستفادات الصالحة سواء من التراث أو من خلاصات التربية المعاصرة، والتأليف بينها في نَسَق يجمع بين العُمق النظري وقابلية التطبيق.
وقد اقتضى رسم المعالم الكبرى لمنهاج تدريس الفقه، التدرج عبر ثلاثة مستويات، أولها التحليل التاريخي للتجارب السالفة، ثم النقد للمعطيات التربوية التراثية والمعاصرة، ثم مستوى البناء والتركيب لعناصر المنهاج الفقهي المنشود.
وبذلك فإن هذا الكتاب يضع بين أيدي المؤسسات التي تعنى بتدريس العلوم الشرعية، مشروعاً متكاملاً لإصلاح منهاج تدريس علم لا تخفى أهميته الدينية والدنيوية.
