إنّ البحث في مجال حقوق الإنسان أمر له أهميته وانعكاساته على مفاهيم الحريات وتعزيزها لما تشكله هذه الحقوق والحريات من أثر على تفعيل العمل الديمقراطي وحماية حقوق المواطنين.
وإذا كانت حقوق الإنسان قد بدأت منذ بدء الخليقة باعتبارها حقوقاً طبيعية لصيقة بالإنسان، بحيث نشأت مع نشأه البشرية فإن الاهتمام بها بدأ يتطور مع تطور المجتمعات على مدى العصور. وإذا نظرنا إلى هذا التطور نجده أصبح معياراً أساسياً في الارتقاء بمفهوم الدولة الحديثة.
وعليه وإيماناً منا بدور الأردن الفاعل في تعزيز هذه الحقوق والضمانات وإفساح المجال أمام مؤسسات المجتمع المدني حكومية وغير حكومية وكذلك المركز الوطني لحقوق الإنسان وغيرها من المؤسسات، فقد آثرت تقديم هذه الدراسة القانونية والدستورية لبيان هذه المفاهيم المتعلقة بحقوق الإنسان وضمانها والقيود الواردة عليها ومبرراتها.
آملين أن نضع هذه الدراسة بين أيادي الباحثين والقراء في هذا الجانب الدستوري، لذلك رأينا أن نعمل في هذه الدراسة بتسليط الضوء على مفاهيم حقوق الإنسان في الدستور الأردني، وموقفه من الحقوق الدستورية والحريات وكيفية حمايتها وإقرار الضمانات الدستورية لهذه الحقوق، وموقف التشريعات المقارنة من ذلك.
كما سنبين كيفية تناول الدستور الأردني، وكذلك القوانين والتشريعات المقارنة للقيود الواردة التي تعمل على إيجاد مبررات للحد من هذه الحقوق لضماناتها في أحوال تحتاج من خلالها الدولة النزول إلى الحد الأدنى للحفاظ على هذه الحقوق والضمانات، سائلين المولى أن يوفقنا في ذلك.
