لم يكن قانون أصول المحاكمات الجزائية الصادر عام 1948/9/18 نتيجة التطور الاجتماعي اللبناني، وتطور العقلية القانونية اللبنانية، فقد استوحاه المشرع اللبناني من قانون التحقيق الجزائي الفرنسي الذي صدر عام 1808 والمؤسف أنه تركه يتجمد وكأنه حقيقة أزلية سرمدية وأبقى عليه من غير تطوير له في ظروف تحتم التطور عن طريق استبدال غيره به، مع العلم أن المشرع الفرنسي قد عدَّل هذا القانون مرات عديدة أهمها تعديل 1865.
أما المشرع اللبناني فلم يضفي على هذا القانون أية تعديلات جذرية إلا في 2001/3/29 حين أقرّت الهيئة العامة لمجلس النواب بالإجماع قانون أصول المحاكمات الجزائية الجديد الذي يضمه هذا الكتاب وذلك في جلستها المنعقدة خصيصاً لإقرار هذا القانون، كما ويحتوي الكتاب أيضاً على مقدمة تتضمن: الوضع التشريعي السابق لصدور القانون الجديد والأسباب الوجبة للتعديل، وكذلك الأسباب التي بنى عليها رئيس الجمهورية اللبنانية رده للقانون في 2001/4/20، وكذلك ردّ النواب على أسباب الرد المقدمة من الرئيس، وإقرار القانون.
هذا الكتاب هو عبارة عن نص قانون أصول المحاكمات الجزائية الذي أقره مجلس النواب بموجب القانون رقم 328 تاريخ 2001/8/2، تليه مقدمة تتناول شرح مختصر لمراحل التشريع الجزائي في لبنان وكيفية إقرار هذا القانون والمشاكل التي اعترضته. ثم يليه فهرس تحليلي أبجدي مفصل يقع في 55 صفحة تساعد الباحث في الرجوع إلى المادة القانونية المطلوبة. ورغم المحاولات العديدة لإعاقة تصريف هذا الكتاب، فقد بيع منه نسخ كثيرة، وهو بشهادة العديد من القضاة والمحامين وطلاب الحقوق الأفضل بين الكتب المماثلة.
