تُعنى أحكام المسؤولية المدنية عموماً بتعويض الضرر الذي يحدثه شخص بغيره نتيجة لإخلاله بالتزام سابق، وذلك سواء أكان هذا الالتزام ناشئاً عن العقد، حيث تثور في هذه الحالة المسؤولية العقدية، أم عن الفعل الضار، حيث تثور المسؤولية التقصيرية، وسواء أكان الضرر في الحالة الأخيرة، ناتجاً عن فعله الشخصي أم عن فعل غيره من الأشخاص الذين يسأل عنهم قانوناً، أم عن فعل شيء من الأشياء التي تخضع لحراسته.
وإذا كانت قواعد المسؤولية التقصيرية عن الفعل الشخصي قد تبلورت في معظم القوانين المعاصرة في قاعدة عامة تقرر أن ((كل خطأ سبب ضرراً للغير، يلزم من ارتكبه بالتعويض))، فإن كلاً من المسؤولية عن فعل الغير والمسؤولية عن الأشياء، قد تضمنت قواعد مشددة بالنسبة إلى المدعى عليه، وذلك بقصد التخفيف من عبء الإثبات الملقى على عاتق المضرور، لضمان الوصول إلى حقه في التعويض. فإذا كان المدعي في المسؤولية عن الفعل الشخصي ملزماً بإثبات أركان المسؤولية الثلاث: الخطأ والضرر وعلاقة السببية بينهما، فهو في المسؤولية عن الأشياء غير ملزم بإثبات خطأ المدعى عليه، وإنما عليه أن يثبت الضرر الذي أصابه، وعلاقة السببية بين فعل الشيء وذلك الضرر فحسب. وهذا التخفيف عن المضرور، هو بلا شك، ثمرة تطور طويل لقواعد المسؤولية عن الأشياء.
