إن الإثبات ووسائله من الموضوعات التي تحتل أهمية في مجال البحث ولا حاجة إلى التدليل على هذه الأهمية في حياة البشر، إذ يكفي أن نشير إلى أنها هي الوسائل التي تمكن القضاء – الذي هو أهم سلطة في الدولة وأسماها – من القيام بمهمته التي هي تحقيق العدالة وصيانة المجتمع عن طريق إيصال الحقوق إلى أربابها وإيقاع العقوبات على مستحقيها؛ لأنه لا يتهيأ للقاضي أن يتوصل إلى الحقيقة من بين ما يقدم إليه من إدعاءات، ولا يستطيع أن يميز بين الحق والباطل من بين ما يعرض عليه من قضايا، إلا بواسطة هذه الحجج والبراهين التي يعضد بها كل واحد من المتقاضين دعواه، ولا شك أن من بين هذه الوسائل، بل ويعتبر أهمها – نظراً لما يثيره تطبيقها والإعتماد عليها أمام القضاء من مشاكل – وسيلة الإثبات بالقرائن، خصوصاً وأنه لا يوجد تقنين لقواعد الإثبات في القانون الإدراي على غرار ما هو موجود في أفرع القانون الأخرى، الأمر الذي يضفي على دراسة القرائن أهمية بالغة لا تقل بحال من الأحوال عن غيرها من موضوعات القانون الإداري، وذلك نظراً لعدم وجود دراسات متخصصة أفردت القرائن بالبحث، وإن كان البعض – كما سيأتي – قد تناولها في المجال الإداري لكن ليس بصورة كاملة تفي بكافة جوانبها وإنما تحدث عنها باعتبارها وسيلة من وسائل الإثبات بجانب غيرها من الوسائل الأخرى.
كما أن دراسة وسائل الإثبات في الفقه الإسلامي لا تقل بحال من الأحوال عن دراستها في القانون الإداري الأمر الذي جعلني أقوم بالبحث في قواعد الفقه الإسلامي بهدف الوصول إلى ما يقابل هذه المسميات في نطاق القانون الإداري، مع محاولة تأصيل ذلك في الفقه الإسلامي، وكشف النقاب عن مكنون تلك القواعد، مع محاولة رد المسميات القانونية إلى أصلها في الفقه الإسلامي وإبراز دور الفقه الإسلامي في هذا الشأن.
