اختلفت مواقف التشريعات الجزائيّة من الجريمة المرتكبة حال المفاجأة بالزّنى عبر العصور، فبعض التّشريعات عدّت الجريمة المرتكبة حال هذه المفاجأة مقترناً بعذر محل، معفي، من العقاب، وأخرى عدّته مقترناً بعذر مخفف له، وذلك لحالة الإستفزاز الذي يصاب به الجاني من هول المفاجأة بمنظر الزّنى الذي تقترفه زوجته أو إحدى محارمه، مما يدفعه إلى إرتكاب جريمة القتل أو الإيذاء حال هذه المفاجأة.
وعلى العكس ممّا تقدم، فإن هناك تشريعات أخرى قد ألغت هذا العذر القانوني ولم يعد له وجود في قوانينها.
كانت هذه الدّراسة محاولة لسير أغوار المفاجأة بالزّنى، إذ أنه مهما كانت مواقف التّشريعات من المفاجأة المذكورة، فإنها لا شك تصيب الجاني - زوجاً أو محرماً - بصدمة نفسيّة كبيرة تفقده شعوره ممّا يحمله على إرتكاب الجريمة بسبب حالة الغضب الذي أثاره الإعتداء على شرفه أو شرف عائلته، إذ أنه يفاجأ، وهو خال البال، بما لم يكن يتوقّعه على الإطلاق.
