رغم مرور مدة طويلة على صدور رواية الجريمة والعقاب للكاتب الروسي فيودور دوستويڨسكي، لا زالت عبارة "الجريمة والعقاب" تمثل عنوانا لكثير من مؤلفات الباحثين الأوربيين من أدباء وعلماء اجتماع. وأنضم اليهم عدد من المؤرخين. قاموا بدورهم برصد واقع الجريمة وما اتصل بها من عقوبات خلال فترات مختلفة من تاريخ أوربا. وعلى غرارهم، تناولنا في هذا الكتاب موضوع الجريمة والعقاب في الأندلس. فعرفنا بالجريمة والعقاب من وجهة نظر التشريع الجنائي الاسلامي. واستعرضنا نماذج من جرائم الحدود والقصاص والديات والتعازير التي ارتكبها الأندلسيون في القرن الخامس الهجري، الذي اخترناه حيزا للبحث. وقد ربطنا تلك الجرائم بالأوضاع التي كانت سائدة في مسرح الجريمة (الأندلس) خلال الفترة المذكورة. وتحدثنا عن الاجراءات الجنائية التي كانت متبعة. وسلطنا، من خلالها، الضوء عن الأطراف والهيئات التي كانت تباشر النظر في الجريمة منذ لحظة ارتكابها حتى تنفيذ الحكم في حق الجاني.
