إنّ الظروف التي تعيشها المجتمعات العربية المختلفة في ظل عدم اكتمال النمو الاجتماعي والاقتصادي والثقافي والسياسي، وما تعانيه من عدم امتلاكها لقراراتها نتيجة غلبة البيروقراطية والسلطوية في التشريع، وعم تجسيد مؤسسات المجتمع للقوى المتواجدة فيه واختلال تمثيلها لطبقات الشعب ومطالبه؛ وعدم توازن واضح بين السلطات التشريعية والتنفيذية وداخل كلا منها على حد سواء، وفي إطار تمثيل الصحافة لكل هذه الأوضاع وانعكاسها لها في الواقع، فإن حرية الصحافة تطرح نفسها كأهم الموضوعات على الساحة في إطار القوانين المستمرة لتجريم هذه الحرية والمحاولة المتأرحجة دائماً من السلطة لإرضاء الصحافيين واستمالتها لهم، في حين تظل أحوال الصحافة بكافة جوانبها كنا هي رغم تغيير هذه القوانين، واختلاف مسميات التجريم وتعدد العقوبات وتناقص التطبيق العملي لها في مخالفة واضحة لنصوصها الأصيلة وروح الدستور النابعة منها.
والمتتبع للتشريعات الجنائية يجد أنها حتى الآن ليست سوى قيود تشريعية تحكم العمل الصحافي ولا تؤدي بأي حال إلى ممارسة حرية الرأي وحرية الصحافة كما أرادها الدستور، وعند النظر إلى التشريعات العقابية في مجال الرأي أو جرائم النشر بصفة خاصة، نجد أن صاحبها كثير من التعسف والاستبداد، إذ أدخل المشرع دائرة التجريم أفعالاً غير مؤثمة بطبيعتها، وكانت وسائله إلى ذلك استعمل عبارات مطاطة غير واضحة المعنى أو محددة الدلالة، وتنطوي على العديد من التفسيرات والتأويلات.
كما أن مشكلة التعارض بين الحرية والسلطة تعد من أعقد المشكلات في الفكر السياسي والدستور، ذلك أن منطق الديمقراطية وأساسها يؤكد أن الحرية السياسية ليست غاية في ذاتها، وإنما هي مجرّد وسيلة لكفالة حرية المحكومين واستقلالهم، ومن ثم يجب أن يكفل التنظيم القانوني للحرية التوازن بين حق الفرد في ممارسة حريته، وبين القيود التي ترى السلطة ضرورة فرضها ردءا لكل عبث وتنظيما لهذه الممارسة. هذا التوازن أمر لازم بالنسبة لجميع الحريات، وهو ألزم بالنسبة لحرية الرأي بصفة عامة وحرية الصحافة بصفة خاصة.
