مما لا شك فيه أن قانون المحاكمات المدنية يعتبر من أهم التشريعات القانونية حيث أنه يبين الطريق المؤدي إلى حصول الإنسان على حقه، ولذا يجيء هذا الكتاب كمادة دراسة تحليلية وتطبيقية في قانون أصول المحاكمات المدنية، من خلال دراسة نظرية الدعوى من حيث تحديد مفهومها وشروطها وأنواعها والاختصاص القضائي وأنواعه وأحكامه، والاجراءات والمدة والتبليغات منذ افتتاح الدعوى وحتى ختام المرافعة، وبيان كيفية إصدار الأحكام وأنواعها، وتحديد مفهوم وإجراءات طرق الطعن في هذه الأحكام والآثار المترتبة عليها. يضاف إلى الدراسة التحليلية السابقة الدراسة التطبيقية المتمثلة في التذكير بأصول عمل المحاكم ووظائفها واختصاصها والمراحل التي تمر بها الخصومة القضائية، بدءاً من مباشرة قيد الدعوى وحتى صدور الحكم فيها، مع بيان تفصيلات مراحل الخصومة واجراءاتها وخاصة نظام الجلسات وكيفية إدارتها، وما يعترض الخصومة القضائية من طلبات ودفوع وعوارض خلال جلسات المحاكمة، وكيفية كتابة الأحكام القضائية وعناصر مشتملات الحكم وتسبيب الأحكام وطرق الطعن فيها. إن الطابع الأساسي لهذا الكتاب تطبيقي عملي من خلال اختيار قضايا من الواقع العملي والتركيز على اجراءات التقاضي ودور المحامين والأطراف المتداعين وإدارة الجلسات، ومعالجة ما يتم على أرض الواقع في جلسات المحاكمة أمام قاضي الصلح في الدعاوي المدنية والتجارية ،ومعالجة المواقف المفاجئة، والطلبات الأصلية والعارضة،وكيفية كتابة الأحكام والقرارات الإعدادية والنهائية، مع الإشارة إلى التعديلات التي طرأت مؤخراً على قانون أصول المحاكمات المدنية وإدخال نظام (قاضي إدارة الدعوى) كمدخل لما يعرف بـ (الحلول البديلة للمنازعات).
