يعتبر مصطلح التكييف الفقهي مصطلحاً حديث الاستعمال في الكتابات الفقهية، إذ لا نكاد نجد له تعريفاً في كتب المصطلحات الفقهية القديمة وفي العصر الحديث ذهب بعض العلماء إلى أنه: تطبيق النص الشرعي على الواقعة العملية. وهناك تعريفات أخرى عديدة أوردها الفقهاء المعاصرون. وهو بعد ذلك أنواع. وقد اكتب التكييف الفقهي للوقائع المستجدة أهمية خاصة في عصرنا لأنه يجعل الفقيه مطلعاً على حقائق الفقه ومتعمقاً فيه كما أنه ضروري لبيان الأحكام الشرعية للقضايا المستجدة، ويعد من لوازم خاتمية النبوة وتوقف الوحي ويعد أيضاً سبباً من أسباب اختلاق الفقهاء.
وفي هذا الكتاب يتناول المؤلف هذا المصطلح بالبحث والدرس من خلال فصول الكتاب الثلاثة. فيعرض في الفصل الأول لحقيقة التكييف الفقهي باعتباره مركباً، وباعتباره لقباً، و الألفاظ ذات العلاقة به وعلاقة التكييف الفقهي بالتكييف القانوني وأنواع التكييف الفقهي ومشروعيته وأهميته وحكمه التكيفي.
ويعرض في الفصل الثاني لمقومات التكييف الفقهي وضوابطه، باعتباره عملاً من أعمال الاجتهاد الفقهي للحكم على الوقائع المستجدة، لا يصار إليه إلا بعد التأكد من وجود مقوماته من أركان وعناصر أساسية هي: الواقعة المعروضة، والأصل الذي تكيف عليه الواقعة، وحكم الأصل ومناص الحكم والمطابقة بين الواقعة المعروضة والأصل الذي تكيف عليه الواقعة أما في الفصل الثالث فيبحث المؤلف في التطبيقات الفقهية على التكيف الفقهي، إذ ينطلق الفقه الإسلامي في تكييفاته وتخريجاته وأقيسته من أصول فقهية ثابتة، وقواعد فقهية مستقرة قررها علماء الفقه والأصول منذ عدة قرون.
