Book Description
إن علم الميراث من العلوم التي ورد التنبيه على علوّ قدرها، وأهميتها البالغة للحاجة إليه في تنظيم الخلافة في الملك بالميراث، وفي معرفة حقوق الورثة وأنصبائهم، وتحديد المستحقين منهم وأوليائهم، وفق ما جاءت به نصوص الشريعة العادلة. والوصية تصرف يشبه الميراث من حيث أن كلاً منهما يرد على مال الشخص بعد وفاته، فالميراث خلافة عن المالك في حاله بعد الموت، والوصية تصرف من المالك في ماله يضاف إلى ما بعد الموت. وقد قسّم الشارع مال الشخص بعد وفاته إلى قسمين: قسم توالى سبحانه تقسيمه بين مستحقيه بحسب مستحقيه بحسب الفرائض التي أنزلها في كتابه، وقسم آخر أوكله إلى صاحب المال يضعه حيث شاء بطريق الوصية.
وفي هذا الإطار جاء هذا الكتاب الذي بين أيدينا وفيه يشرح المؤلف أحكام الميراث والوصية في الشريعة الإسلامية، وذلك من خلال تقسيمه مادة بحثه على قسمين عرض من الأول لتعريف الميراث وأهميته، ومعناه وحكمة مشروعيته، والأسس التي يقوم عليها والأحكام التي تسرى عليه وأركانه وشروطه وأسبابه وأنواعه وترتيب الورثة المستحقين... أما القسم الثاني فخصصه للحديث عن معنى الوصية وحكمها ودليلها، وأركانها وشروطها وأنواعها وأحكامها. كما وأضاف ملحقاً خاصاً جمع فيه مواد القانون الصادر سنة 1423 رقم 7 والمختص بأحكام الوصية. والكتاب بشكل عام موجّه لطلاب الدراسات الإسلامية، ولطلاب الحقوق ولجميع المهتمين بهذا النوع من الدراسات.
