وكثير من أحكام الوقوف ثابتة بالإجتهاد لأن النصوص الواردة فيها في جملتها عامة الدلالة، مما دعا العلماء والفقهاء إلى بذل الجهد في تفصيل أحكامه وبيانها، ويعد هذا العموم ميزة توسع مجالات الوقف وتواكب متغيرات الزمان.
ويتسم الوقف بسمات وخصائص أهمها أن الوقف من الصدقة الجارية على أعمال البر، والتي يراد منها الأجر والمثوبة، وإستدامة منفعتها في الدنيا والآخرة، وهو من عقود التبرعات التي يقصد منها التقرب والطاعة، والتأييد والإستدامة من خصائص الوقف بحيث لا يمكن التراجع عنه أو فسخه.
إلي ما يحققه الوقف من مشاركة فعالة في التنمية ومساندة جهود الحكومية في توفير ما يحتاجه المجتمع من موارد تلبي إحتياجاته ومصالحه، وما يتميز به الوقف من شمولية في أنواعه ومجالاته ومصارفه المتنوعة التي تحقق شتى حاجات الأمة.
