وبعد ذلك وأمام حاجة الإستغلال البحري في العصر الحديث إلى إمكانيات كبيرة ومبالغ أكبر ينوء بحملها من يقوم بهذا الإستغلال بالإعتماد على مواردهم فحسب، فما كان منهم إلا التوجه إلى أصحاب رؤوس الأموال الذين كانوا يرفضون تقديم ذلك الإئتمان ما لم يحصلوا على الضمانات التي تطمئنهم لإستيفاء ديونهم، وأزاء ذلك ولأهميته أضفى المشرع البحري في الدول المختلفة ضمن قوانينها البحرية وصف الإمتياز على الكثير من الديون البحرية التي تنشأ بمناسبة السفينة أو الرحلة البحرية.
بيد أن هذه الإمتيازات البحرية التي قررتها الدول تختلف من دولة إلى أخرى فقد يتمتع الديْن البحري بوصف الإمتياز طبقاً لقانون الدولة ما في حين يكون ديْناً عادياً في دولة أخرى وهكذا، كما تختلف الدول فيما بينها أيضاً في تقرير الأولوية للإمتيازات البحرية.
