تبقى مقولة الإجتهاد الفقهي تشغل المقام المهم في منتدى الدراسات الفقهية والأصولية، فهي المدى الرحب الذي يتحرك في أجوائها دعاة الهم الفكري والمعرفي، بغية تحويل حركية تلك الهموم إلى واقع يواجه التخلف، ويذوّب التحديات والأسئلة القلقة بالبناءات المعرفية الإسلامية، القادرة على رفد الوعي وتدعيم القناعة بقدرة الإسلام على إستيعاب التطورات الإنسانية وتنظيم حياة الفرد والمجتمع تبعاً لها، وفقاً لضوابط منظومته المعرفية والتشريعية والأخلاقية.
لم يكن الإجتهاد الفقهي بذاته دعوة إلى التجديد، فحسب بل هو دعوة إلى التأصيل في واقع المعاصرة، لأنه يحمل هموم المجتمع، وحلِّ إشكالياته في كل مراحله.
فلذلك كانت مهمة إختيار موضوع كهذا ليست بالمهمة السهلة إذ تتفعل به خطوط الموازنة والكشف لكثير من الملفات الحساسة وتلمس الحضور المعرفي ضمن مجالات البحث الفقهي وتطويره معتمداً على الدقة الموضوعية ما خلا الحقيقة التي يبرزّها النص القطعي أو الدليل الكاشف.
فكان الفقه على عصر المعصومين عليهم السلام علماً سهلاً متاحاً وضرورياً، أما وقد بَعُدَ بنا العهد عن عصر الوحي والتشريع الإسلامي - حوالي أربعة عشر قرناً - فقد أضحى علماً نظرياً إستدلالياً وأكثر تعقيداً عما كان عليه في إنطلاقته الأولى، ولهذا السبب نرى إستحالة الوصول إلى فقه خالص دون الإستعانة بعلم أصول الفقه وحركة الإجتهاد.
حيث تتلخص أهمية علم الأصول في أنه يهيء للإنسان الأدوات والأسباب اللازمة التي تمكنه في سعيه لإستنباط المسائل الفقهية والمحيطون بتعقيدات الفقه وتشعباته، أدرى من غيرهم بمدى الأهمية التي تنطوي عليها عملية الإطلاع على المباحث المهمة في علم أصول الفقه للوصول إلى الإستنباط الفقهي الصحيح.
