نشأ في كل عصر علماء في الأمة جعلهم الله ورثة الأنبياء وحملة رسالة الإسلام ارتضتهم الأمة، لقد اجتهد كل واحد من هؤلاء العلماء للوصول إلى حكم الله ورسوله بكل أمانة ودقة، وفقد أفتى هؤلاء العلماء الناس ما وصل إليه علمهم، وقد اختلفوا في مسائل، وليس هذا الاختلاف الذي نهي عنه لأنه لم يكن عن هوى، بل هو خلاف شرعي له أسبابه ودواعيه. لقد كتب العلماء في أسباب الخلاف قديماً وحديثاً.
وكتاب "اختلاف العلماء" الذي نقلب صفحاته هو من أجلّ كتب الخلاف، جمع فيه "المروزي" أكثر المسائل المختلف فيها بين علماء الأمة ممن يرجع إلى قولهم في الخلاف مع ذكر الأدلة وترجيحها بدون ميل أو تحيز لأحد. هذا وقد جاء الكتاب محققاً؛ وتجلى عمل المحقق في تخريج الأحاديث النبوية والآثار المروية، ترجمة مختصرة للفقهاء الذين نقل المصنف أقوالهم؛ كما وعني المحقق بوضع فهارس تفصيلية لموضوعات الكتاب المختلفة.
