نبتت فكرةُ هذا الكتاب أثناء العمل على كتابي السابق نشأة الفقه الإمامي ومدارسه، هناك تفحّصنا الحركة الشّاقّة الطويلة من الحديث بإتجاه الفقه، من النصّ المَروي إلى النصّ المُستنبَط، التي بدأت في قمّ واستقرّ بها المقام في الحلّة، أي أن ميدان بحثنا كان هناك الحديث - الفقه، بما هو حديث، وبما هو فقه.
لكن، وكما يحدث غالباً ببركة وسحر البحث، فإنّ معالجة الإشكاليّات التي فرضها البحث هناك طرحتْ أسئلةً وإشكاليّاتٍ جديدة، حرّكت لدينا تساؤلاتٍ دارت على أولئك الذين كانوا وراء تلك الحركة المُباركة في مُفترقاتِها الأساسيّة: مَن هم، ما هو الوسط الذي عملوا فيه، وماذا أنتجوا؟...
عملنا هنا سيدور على الرُّوّاد أبطال تلك الحركة، بوصفهم من النُّخبة العالية، التي من شأنها ودأبها أن تُطلق وأن تقود عمليّة التأثُّر والتأثير الإيجابي المُتبادَل في ومع الوسط الثقافي السياسي الإجتماعي الذي تعمل داخلَه.
آخذةً منه حوافزها ومُحرّكاتها، لتمنحه في المُقابل فكراً أو عملاً مَبنيّاً على الجديد المُبتكَر من الفكر، يرمي إلى وضع حُلولٍ لمشكلاتٍ قائمةٍ في عنصرٍ من عناصر وسطه الثلاثة.
أولئك هم الذين منحناهم في عنوان الكتاب صفة "الرُّوّاد".
إذن، فالكتابان، نشأة الفقه وهذا، يخوضان العُبابَ المُدوِّمَ نفسَه، كلُّ ما في الأمر أن كتابنا السابق نظر إلى الموضوع الذي هو النّصّ التشريعي الذي بدأ مَرويّاً ثم انتهى مُستَنبَطاً، أو فلنقُل، بدأ حديثاً ثم انتهى فقهاً، أي أنّه أزاح النّصَّ المَروي إلى موقع ما، لكنّه دائماً خلف النّصّ المُستَنبَط، بأن اكتفى بمنحه مكاناً ما ضمن مصادر الإستنباط، بعد أن كان من قبلُ كلَّ شيء تقريباً.
أمّا هذا الكتاب فإنّه ينظر إلى الرجال الذين كانوا وراء هذه العمليّة التطوّريّة المُعقّد، وشتان ما بين المنظوريَن.
