Book Description
ولد تشيزاري بونيزانا، ماركيز بكاريا، في ميلانو (1738) وتوفي فيها (1794). تأثر بمونتسكيو والإنسكلوبيديين الفرنسيين وأولى اهتماماً باكراً بالعدالة في النظام القضائي. كتب أشهر كتبه رسالة في الجرائم والعقوبات (1764) وهو لم يتعد بعد الستة والعشرين من العمر.
وضع بكاريا في هذا الكتاب أسس التفكير المعاصر في ميدان القانون الجزائي، استخدام حججاً قديمة، لكنه صهرها في بوتقة واحدة، وفصلها عن الإطار الديني. وضع قواعد إنزال العقاب، واقترح الموازنة بين العقاب والجريمة. ندد وبوحشية بعض العقوبات غير المتوازنة والجريمة، ورأى في الإعدام وأنواع التعذيب ممارسات "بربرية". واعتبر أن الإعدام "غير المفيد وغير المبرر" جريمة قضائية".
لاقى كتابه رواجاً عظيماً وترجم بسرعة فائقة إلى معظم اللغات الأوروبية وعلى رأسها الفرنسية (1765) والإنكليزية (1768). وها هو اليوم يصدر بترجمة عربية أمينة.
