إن إفراد التشريع الإسلامي لجرائم معينة بالذات موضع تساؤل وذو أهمية جديرة بالكتابة فيه وإطلاع القارئ على أهمية إقرار عقوباتها من الله تعالى وتحديدها إلا لأهميتها وخطورتها، لأن عقوباتها هي صمام الأمان للمحافظة على الضرورات الخمس:
حفظ الدين، والنفس، والنسل، والعقل، والمال. وهي البلسم الشافي من أدوائها وغرس الإرادة المؤمنة، والقضاء على الجرم والجريمة، وجدارتها في حسم الصراع لصالح الخير ضد الشر الذي لا ينتهي، لأن الشريعة الإسلامية الغراء جاءت شاملة، وخاتمة، وجاء كتابها القرآن الكريم مهيمناً، فلا يتطرق إليها الشك إلا عند المغرضين..
إنما تؤشره إحصائيات الأمم المتحدة ووزارات العدل والتقارير الاجتماعية في العديد من البلدان النامية والمتقدمة إلى زيادة عدد الجرائم، كالقتل، والزنا، والقذف، والسرقة، والحرابة، وشرب الخمر، والبغي، التي أصبحت تهدد كل إنسان وتطول كل برئ إلا دلالة عن عجز النظم والقوانين الوضعية على تحقيق الأمن في المجتمع.
إن التمسك بالقوانين الوضعية ضعيفة الردع ومغرية في زيادة الجريمة ومشجعة لها وهي التي سببت الكثير من العناء والشفاء لأبناء المجتمع، وذلك لعجزها عن المساهمة في مكافحة وعلاج الموبقات والأمراض الإجرامية فيه، وكبح انحرافات ورغبات الشعوب التي أرهقتها هذه الآفاق.
والجديد هو إبراز سمو التشريع الإسلامي من خلال عرض الحدود الشرعية ومقاصدها وآثارها، وبيان مظاهر الرحمة والتيسير فيها، وإثبات فاعليتها ومحاولة الرد على الطعون التي يثيرها بعض المستشرقين والمغرضين ونعت عقوباتها بالقسوة والهمجية التي لا تناسب العصر الحاضر المتقدم في نظرهم.
في هذا الإطار تأتي الرسالة التي بين يدينا والتي تعرض لموضوع الحدود في الإسلام بأسلوب يجمع المنهجين التحليلي والاستقرائي، حيث تقدم تراث وآراء السابقين من الصحابة والتابعين وتابعي التابعين من الذين كرسوا جهودهم في التفسير والحديث وغاصوا في علوم الشريعة ليستفاد منه ويربط بالجديد ليتم التواصل ويستمر في بيان لا يأتيه الباطل من بين يديه ولا من خلفه، فكانت أحكامه قطعية وشافية.
