لقد حدث لأحد أقارب المؤلف- حالة إغماء استمرت أياماً, بقي خلالها في غرفة الانعاش, وحرص الفريق الطبي على تهيئة واستعمال كافة الوسائل والأجهزة المساعدة التي يمكن استعمالها في مثل هذه الحالة, ثم أفادوا بعد أيام بأن المريض قد توفي متأثراً بحالة الإغماء هذه, والتي كانت قد نشأت عن زيادة في ضغط الدم, أثرت في تفجير شرايين الدماغ. سألت الطبيب المشرف على متابعة الحالة- قبل إعلان الوفاة- هل لبقاء أجهزة الإنعاش- والحالة هذه- تأثير في تحسن الحالة؟ فأجاب بالنفي. فقلت إذن لماذا لا تنزع هذه الأجهزة؟ ولم كل هذا الحرص على بقائها طالما أنه لا فائدة منها؟ فقال: لو كنت في أمريكا لنزعت الأجهزة, لأن المريض مات طبياً. فقلت: إنني أعرف كما تعرف ويعرف كل الناس أن الموت واحد هنا وفي أمريكا. فأجاب أننا في مثل هذه الحالة نبقي الأجهزة فترة من الزمن لكي تمتص أثر الحالة المفاجىء على أسرة المريض وأقاربه, مع قناعتنا بأن المريض قد مات طبياً. ومنذ ذلك الوقت والمؤلف يتساءل, هل للموت ضابط عند الفقهاء يحكمون به عند حصول ظواهر وعلامات معينة محددة يجزمون بناء عليها بأن الشخص قد مات؟ وبالتالي تجري الأحكام المترتبة على الوفاة. فجاء هذا الكتاب للإجابة عن هذه المسألة وأهميتها, من خلال عرض المواضيع التالية: الوفاة في الكتاب والسنة, الوفاة عند أهل اللغة, الوفاة عند الفقهاء, الوفاة عند الأطباء, بالإضافة الى ما يظهر من اقتراحات أو توصيات حول الموضوع.
