قانون العقوبات هو مجموعة من القواعد القانونية تحدد الأفعال التي تعد جرائم وتبين العقوبات المقررة لها. ويضم قانون العقوبات نوعين من القواعد: قواعد عامة تسري على كل الجرائم أو أغلبها وعلى كل العقوبات أو أغلبها، وقواعد خاصة بكل جريمة على حدة تبين أركانها وتحدد عقوبتها، والجريمة في قانون العقوبات هي واقعة قانونية والعقوبة هي النتيجة القانونية المترتبة عليها، وتحدد قواعد قانون العقوبات الشروط التي تكتسب بها الواقعة أهمية قانونية فتعد جريمة، وتصلح لأن تترتب عليها آثار قانونية من نوع خاص، هي العقوبة وما يلحق بها من نظم جنائية. وينقسم قانون العقوبات إلى قسمين: القسم العام والقسم الخاص. فالقسم العام يضم الأحكام التي تخضع لها الجرائم والعقوبات على اختلاف أنواعها، والقسم الخاص يجمع القواعد التي تحدد أركان كل جريمة على حدة والعقوبة المقررة لها. وقد أخذ الشارع اللبناني بهذا التقسيم: فالكتاب الأول من قانون العقوبات يضم أحكام القسم العام والذي هو مدار البحث في الكتاب الذي بين يدي القارئ والكتاب الثاني يضم أحكام القسم الخاص. ويعد هذا التقسيم أساساً لدراسة أحكام قانون العقوبات. ذلك أن القسم العام، يجمعه بين أحكام تشترك فيها كل الجرائم والعقوبات أو أغلبها يغني الباحث والمهتم بهذا الموضوع عن تكرار هذه الأحكام عند دراسة كل جريمة على حدة، وهو بالإضافة إلى ذلك يبرز في صورة واضحة الأحكام العامة التي تعد بمثابة المبادئ الأساسية التي يقوم عليها القانون الجزائي الحديث.
