إن ميل ميزان القوى لمصلحة الولايات المتحدة الأمريكية بعد سقوط الإتحاد السوفيتي وتفكك منظومة أوروبا الشرقية قد انعكس على تصريحات زعماء وساسة أمريكان قاموا بإطلاق تصريحاتهم وتنظيراتهم حول مستقبل النظام الدولي.
وهكذا، فإن العولمة بإعتبارها إحدى المتغيرات الدولية دعوة أمريكية مغزاها إقامة حضارة تسلطية، هذا سوف يكون له إنعكاس على بعض مبادئ القانون الدولي العام.
ونظراً لعدم قدرة بعض مبادئ القانون الدولي العام التقليدية على تلبية متطلبات المرحلة القريبة المقبلة، فإن إمكانية تعديلها وفق معايير وأطر تنظيمية تنسجم وواقع المرحلة القريبة المقبلة تندرج في التساؤل الآتي: هل أن هناك علاقة ما بين مبادئ القانون الدولي العام والعولمة؟ وهل أن لسمات العولمة وأبعادها المختلفة تأثيراً على مبادئ القانون الدولي؟ وهل أن هذه المبادئ سوف تستجيب لهذا التأثير؟ وإذا كان التأثير سوف يغير في تلك المبادئ فهل هذا يعني أن هذه المبادئ سوف تصبح عديمة الجدوى أم أنه سوف يطرأ عليها تغيرات؟.
إن هذه التساؤلات تمثل الإشكالية التي انطلقت منها هذه الدراسة، مبيناً أثر العولمة على بعض مبادئ القانون الدولي عبر التاريخ وما ستؤول إليه تأثير مفاهيم وتطبيقات العولمة الحالية والمستقبلية عليها.
ولقد تم تقسيم هذه الدراسة إلى أربعة فصول، الفصل الأول تناول ماهية العولمة، أما الفصل الثاني فقد تناول علاقة مبادئ القانون الدولي العام بالعولمة، أما الفصل الثالث: فقد تناول تأثير العولمة في مبادئ القانون الدولي العام، أما الفصل الرابع: فقد تناول المكانة الدولي للشركات متعددة الجنسية في ظل العولمة كدراسة تطبيقية لتأثير العولمة.
تعد العولمة أهم افرازات ذلك التحول واحدى المستجدات والمتغيرات الدولية التي لفتت أنظار الكثير من الباحثين لدراستها والتعرف على كوامنها والبحث في أبعادها المختلفة.
فالعولمة وإن كانت حديثة العهد نسبة الى حداثة المصطلح الا أنها كفكرة تكاد تكون موغلة في القدم.
