تؤسِّس هذه الدراسة لنظرية في تفسير النصوص تقوم على فكرة: أن النص القانوني-ومثله الشرعي- ليس كأي كلام عادي، بل هو حصيلة إرادة واعية هادفة تتجسد في عبارات مسبوكة تراعي فيها الضوابط اللغوية والمنطقية و أن لهذا النص مقومات ثلاثةً أولاها :مفردات النص من حيث وضوح المعنى أو إبهامه،ومن حيثيات أخرى فصلتها مطولات علم أصول الفقه. وثانيتها:دلالة النص من حيث المنطوق والمفهوم،وحيثيات أخرى كذلك. وثالثتها:حكمة النص،ذلك أن القاعدة القانونية –ومثلها الشرعية- هادفة إلى تحقيق مصالح الناس،فلها روح بها تتفاعل مع المجتمع المتجدد دوماً،وبدون هذه الروح تُولَدُ القاعدة ميتة. وقد بينت بوضوح أن التفسير:هو التعرف من خلال تحليل ألفاظ النص ودلالاته-بحسب الضوابط المعروفة،والغاية الاجتماعية له-على الحكم المنشود.وترى أن أي نص فقد روحه يفقد قيمته القانونية. وقد أثبتت هذه الدراسة من خلال مقارنتها بين المنهج الفقهي الإسلامي وبين المنهج الغربي لتفسير النصوص،أن المنهج الإسلامي للتفسير-الذي يتولاه علم أصول الفقه –يتميز بعمق ضوابطه،ووضوح قواعده،وهو ما يفتقده المنهج الغربي .
