إن مبدأ المداينات في التعامل التّجاري، يشكّل ركيزة من ركائز الإقتصاد البشري، وبدونه تتعطّل مصالح الناس، ويصيبهم الحرج، فهو أمر لا بدّ منه.
والمدين معرّض أحياناً للوقوع بأزمة ماليّة، لأسباب خارجة عن إرادته، وليس بوسعه تجنّب حدوثها، الأمر الذي يجعله عرضةً لشهر إفلاسه.
ولا يخفى ما للإفلاس من آثار سيّئة تنسحب على المدين وعلى الدائنين، وعلى سمعة البلد الإقتصادية؛ لذلك بحث المؤلف في الوسائل الواقية من الإفلاس، متبعاً في ذلك منهج الدراسات المقارنة، مبيناً الوسائل التي نصّ عليها القانون الوضعي، وتلك المنصوص في فقه الشريعة الإسلامية، ومظهراً أي الوسائل أفضل لوقاية المدين من الإفلاس.
