نظراً إلى تزايد انضمام الدول النامية إلى منظمة التجارة العالمية، وكذلك تزايد لجوئها إلى إجراءات تسوية المنازعات فيها أكثر مما كانت الحال عليه في اتفاقية (الجات 1947)، إلى جانب أن دراسة آلية تسوية المنازعات تؤدي إلى زيادة في فهم الاتفاقيات التجارية المرفقة باتفاق المنظمة، لأن قواعد مذكرة التفاهم وأحكامها تعتبر المرجع لبعض الاتفاقيات في حالة خلو هذه الاتفاقيات من تنظيم النزاع، فمن ذلك كله يتجلى أهبة إلقاء الضوء على آلية تسوية المنازعات في المنظمة، للوقوف على تفاصيلها ومميزاتها وعيوبها. وفي هذا الإطار جاءت الدراسة التي بين أيدينا والتي يتعرض فيها الباحث ابتداء للجهاز المسؤول داخل المنظمة عن تطبيق آلية تسوية المنازعات وهو جهاز تسوية المنازعات، وذلك ليوضح القارئ مهامه والغاية منه وسلطانه وكيفية اتخاذه لقراراته، كما ويتطرق فيها بعد ذلك إلى طبيعة المنازعات التي تدخل ضمن اختصاص هذا الجهاز، ولطبيعة القواعد والإجراءات التي تحكم تسوية المنازعات التجارية للدول الأعضاء في المنظمة، ومن ثم تعرض لطرق تسوية النزاع الذي يحدث بين دولتين عضوين أو أكثر في المنظمة منذ حددت النزاع حتى تنفيذ القرار الصادر عن جهاز تسوية المنازعات من قبل الدولة المخالفة، مع تحديده للسبل الممكن اتخاذها في حالة عدم تنفيذ القرار.
وعلى ذلك عالج الباحث في دراسة هذه الموضوعات التالية: جهاز تسوية المنازعات في المنظمة والإجراءات الودية كل المنازعات، وإحالة النزاع إلى الهيئة التي يشكلها جهاز تسوية المنازعات، واستئناف قرار الهيئة، وتنفيذ القرارات والتوصيات الصادرة عن جهاز تسوية المنازعات، وتقييم آلية تسوية المنازعات في منظمة التجارة العالمية.
