إن علم القضاء من أجلّ العلوم قدراً، وأعزّها مكاناً، وأشرفها ذكراً، لأنه مقام عليّ، ومنصب نبوي، به الدماء تعصم وتسفح، والأبضاع تحرم وتنكح، والأموال يثبت ملكها ويسلب.
فالسلطة القضائية هي إحدى سلطات الدولة الحديثة، ووظيفة القضاء أقدم وظيفة عرفتها المجتمعات البشرية، من أجل إقامة العدل بين أفرادها، ونشر الامن والطمأنينة بين الناس، ولهذا نشأت السلطة القضائية، فالقضاء من أهم الموازين للحكم على كل مجتمع من حيث الرقيّ والتقدّم أو التخلّف، من أجل ذلك، جاء الإسلام فأولى القضاء عناية فائقة، فكان القضاء فريضة محكمة وسنّة متّبعة.
وأمام القضاء يجلس الحاكم والمحكوم، والشريف والوضيع، والغني والفقير، والرجل والمرأة، والكبير والصغير، فالكل سواء أمام القضاء، والتاريخ الإسلامي زاخرٌ بالأمثلة الكثيرة والخالدة في تطبيق مبدأ المساواة في جميع العصور، سنذكرها بعضها - إن شاء الله تعالى - في طيات هذا البحث.
فقد تم تقسيم البحث إلى ثمانية مباحث، وفي كل مبحث مطالب على النحو الآتي: المبحث الأول: في تعريف القضاء لغة وإصطلاحاً، وأدلة مشروعيته من الكتاب والسنة والإجماع والمعقول، المبحث الثاني: القضاء في العهد النبوي، المبحث الثالث: القضاء في عهد الخلفاء الراشدين، المبحث الرابع: القضاء في العصر الأموي، المبحث الخامس: القضاء في العصر العباسي، المبحث السادس: القضاء في الأندلس وشمال أفريقيا والمغرب العربي، المبحث السابع: القضاء في العصر العثماني، المبحث الثامن: القضاء في المملكة الأردنية الهاشمية.
