Book Description
الميزة الفردية وهي ما يسمى الحق ليس مطلقاً عن الضوابط، لأنه من الخالق وهو واضع ضوابطه وحدوده فلا تُجتاز، ولا يُساء في إستعماله، وإنما يجرى على وفق ما شرع الله عزّ وجلّ وأراد، وهو تعالى قصد من منحه الحقوق التعاون على إقامة دين الله تعالى، وتحقيق مقاصده في الخلق، حتى إذا خالف الحق الغاية الشرعية، وصار أداة هدم لمقاصد الله عزّ وجلّ ومصالحه العادلة، وأسئ في إستعماله بشكل يضر الآخرين، وقف الإسلام في وجه مستعملي الحق على هذا النحو يظهر لهم مضادتهم لغرض الله عزّ وجلّ من الحق، ومنعهم من التمادي في إستعماله، حتى لا يؤدي إلى مفاسد ممنوعة.
ونظرية التعسف والتي تقوم على فكرة تقييد الحق بما يوافق غايته الشرعية من تحقيق المصالح المطلوبة منه، واحدة من النظريات التي تميز بها الفقه الإسلامي، والتي تظهر النظرة الواقعية للإسلام بأن الفرد جزء من الجماعة، وان حقوقه وحرياته مصانة ما صان هو حقوق الجماعة وحافظ عليها.
فليس في الإسلام حقوقاً مطلقة، وإنما وحدة متماسكة مترابطة من الحقوق المختلفة للأفراد تؤول جميعاً إلى خدمة المجتمع، وإقامة شرع الله تعالى.
والنظرية تتبسط على جميع الحقوق المتعلقة بنواحي الحياة المختلفة، فمتى وُجد الحق وُجدت غايته معه، وكنُنا مطالبين بتحقيقها، إلا أني وجدت أنه تتكشف أكثر مما تتكشف في مجال الأحوال الشخصية، وعلاقات الإنسان مع زوجه وأولاده، وأهله وقرانه، من خلال مراحل وفترات تمر بالمرء، يملك في كل منها جملة حقوق تقابلها مجموعة واجبات، كما في حماية مال الصغير اليتيم حتى يكبر وما يقابله من حق الوصاية، وواجب حفظ المرأة والإنفاق عليها وما يقابله من حق الطاعة والقوامة، وهكذا في سائر الحقوق، جلباً لمصلحة حفظ الدين والنفس، والعقل والنسل والمال، وهي مقاصد الله تعالى في خلقه، وتحقيقها من خلال إقامة الحق على الوجه الشرعي في مسائل الزواج والطلاق والولاية والميراث وهي ما يدور البحث عليها.
