لم تقف مصادر أحكام الشريعة الإسلامية عند النصوص الشرعية التي وردت في القرآن الكريم والسنة المطهرة، وإنما سلكت طرقاً ومصادر أخرى لاستنباط الأحكام يفزع إليها المجتهد التماسكاً لحكم ما يحدث من الوقائع مما لم تتعرض له النصوص. فأصبحت هذه الطرق والقواعد من مصادر الشريعة الإسلامية بعد أن أقامت الشريعة دلائل عليها ونصبت إمارات.
هذا الوضع أوقع الخلاف بين الأصوليين والأخباريين في بعض هذه المصادر وهو خلاف ترك مناقشات وردود كثيرة من قبل الطرفين، وهذه الدراسة تقف على بعض نقاط الخلاف بين الأصوليين والأخباريين وما جرت إليه من نزاع طويل، جعل الكاتب بصدد البحث عن مصادر الاستنباط بين الصوليين والإخباريين بغية إعطاء صورة عن مصادر الاستنباط في زمن الرسول صلى الله عليه وسلم إلى زمن غيبة الامام الثاني عشر الكبرى عام 329هـ وتناولاً أهمية العقل في الكتاب والسنة، وموقف السنة من دليل العقل حيث تركز الحديث عن طوائف ثلاثة هي: الأشاعرة، والماتريدية، والمعتزلة، مع ذكر الخلاصة عن هذه الآراء. كذلك يتناول الكاتب موقف الأصوليين من دليل العقل وكذا موقف الاخباريين مع ذكر أدلتهم على نفي حجية دليل العقل بالمفهوم الأصولي وأخيراً موازنة وتقويم لآراء الطرفين.
