يعتبر حق الملكية من أوسع الحقوق العينية نطاقا وهو جامع هذه الحقوق وأساسها، ولا ينشأ حق الملكية لشخص ما من تلقاء نفسه، أي أن الشخص لا يصبح مالكاً دون أن يكون هناك سببا من أسباب كسب الملكية، فقد تكتسب الملكية بالإستيلاء عن طريق إحراز المباحات أو بالميراث وكذلك قد يكتسبها الشخص بالعقد أو الوصية، وتكتسب كذلك بالشفعة وبالحيازة وأخيرا بالإلتصاق.
وقد نظمت القوانين أحكاماً للإلتصاق باعتباره واقعة مادية مكسبه للملكية، والإلتصاق على نوعين، إلتصاق طبيعي وهو ما يحدث بفعل الطبيعة ولا دخل لإرادة الإنسان بحدوثه، والتصاق صناعي والذي يحدث بفعل الإنسان، إذ قد يقوم شخص باستحداث بناء أو غراس أو أية منشآت أخرى على أرض الغير، أو قد يقوم صاحب الأرض أو أجنبي بإقامة محدثات بمواد الغير، بحيث تندمج هذه المحدثات اندماجا لا يقبل الإزالة أو القلع دون تلف. وقد فرقت هذه القوانين بين أن يكون المحدث سيىء النية وبين آخر لديه من الأسباب الشرعية ما دفعته لإقامة هذه المحدثات. ولما للنية من أثر في مثل هذه الواقعة فإن موضوع هذا البحث سيكون الزعم بسبب شرعي في الإلتصاق الصناعي حيث ستنقسم الدراسة إلى ثلاثة فصول تخصص الفصل الأول لبيان مفهوم الزعم بسبب شرعي في الإلتصاق الصناعي. أما الفصل الثاني فسيعرض من خلاله الأحكام المحدثات في نطاق نصوص الإلتصاق الصناعي. أما الفصل الثالث ستبحث فيه التطبيقات التشريعية والعملية لإحكام المحدثات بزعم سبب شرعي.
وسينتهي البحث بخاتمة درجت فيها ما توصل إليه من خلال الرسالة من نتائج ومقترحات.
