قانون الإجراءات المدنيّة والتجاريّة هو القانون الذي يضع القواعد التي تنظّم القضاء في الدولة من حيث تحديد جهات القضاء فيها وولاية المحاكم ومدى اختصاصها النوعي – القيمي أو الموضوعي – والمحلي بالقضايا التي تدخل في ولايتها، كما ينظّم الإجراءات الواجبة الإتباع عند اللجوء إلى المحاكم واللازمة للفصل في القضايا وطرق الطعن في الأحكام الصادرة منها وكيفية تنفيذها.
إن القضية، كأداة للممارسة الحق في التقاضي، هي إدعاء بوجود نزاع حول حق أو مركز معين (أي الدعوة كمظهر مادي للقضية) يعرض على القضاء في شكل معين وبإتباع إجراءات معنية (أي الخصومة كمظهر شكلي للقضية). والقضية التي تتعلق بحماية الحقوق والمصالح الخاصة تتنوع على حسب العوارض التي تصيب التظام القانوني إلى قضية موضوعية وقضية مستعجلة:
فالقضية الموضوعية تكون في حالة وجود جهل بقواعد القانون التي تحمل الحقوق الخاصة سواء أكان الجهل بحسن نية أو عن عمد وذلك بهدف الوصول إلى اليقين القانوني بصدد الشك حول الحقوق وهذا يؤدي إلى تحقيق الاستقرار القانوني حولها. وأن التأكيد القضائي على وجود أو عدم وجود الحق أو المركز القانوني أو الإلزام بأداته أو نشأته يستتبع إزالة ما يعتري القواعد القانونية من تجهيل أو غموض يحول دون نفاذها.
أما القضية المستعجلة أو الوقتية تنشأ في حالة وجود الخشية من فوات الوقت أو الخطر المحدق أي الخشية من التأخير في إعمال القانون أو تنفيذه. فيكون المطلوب فيها اتخاذ تدابير وقتية لوقاية الحقوق من خطر ضياعها بسبب التأخير في حمايتها الموضوعية.
لذلك سوف نقوم بالدراسة التفصيلية لكل من القضية الموضوعية (القسم الأول) والقضية المستعجلة (القسم الثاني).
